WIWO Media, a trade name of CW Nederland B.V., provides hosting, email, VPS and related services. This makes us a provider of hosting services within the meaning of the Digital Services Act (DSA). This page explains how to report content or conduct on our services that you consider unlawful or contrary to our acceptable use policy, what we do with a report, and how authorities and customers can reach us.
This English version is provided for convenience. In case of any discrepancy, the Dutch version prevails.
Who we are
CW Nederland B.V., trading as WIWO Media PO Box 605 3200 AN Spijkenisse The Netherlands
Chamber of Commerce (KvK) number 92544347. Further details are available at /en/company-details.
We host websites, email and servers for our customers. We do not publish our customers' content ourselves and do not review it in advance. We do take action when we become aware of content or conduct that is unlawful or contrary to our terms.
How to submit a report
Send your report by email to abuse@wiwomedia.nl. This is our electronic notice mechanism. Reports can be submitted in Dutch or English.
To help us assess your report carefully and quickly, please include the following:
- A substantiated explanation of why you consider the content unlawful or contrary to our acceptable use policy, for example which right is being infringed or which legal provision applies.
- The exact location of the content, such as the full URL or URLs. For email, please attach the complete message, including the full headers. For other content, tell us where and how we can find it.
- Your name and email address. Reports concerning child sexual abuse material may be made anonymously.
- A statement that you are acting in good faith and that the information in your report is accurate and complete to the best of your knowledge.
If your report concerns an infringement of copyright, trademark rights or another intellectual property right, please also include:
- which work or right is being infringed;
- evidence that you are the rights holder, or that you are authorised to act on the rights holder's behalf (for example a power of attorney);
- your full contact details, including a postal address.
We will still process a report that lacks these details, but we may first ask you for additional information. Only when a report is sufficiently precise and substantiated can we establish, without a detailed legal examination, whether the content is unlawful.
Reporting spam, phishing and malware
If you receive spam or phishing sent through our servers, or find malware or a phishing page on a website hosted by us, please report it to abuse@wiwomedia.nl as well, including:
- for email: the complete message as an attachment or with the full headers (forwarding the text alone is usually not enough);
- for a website: the full URL and, if available, a description of what you saw and when;
- for an attack or scan originating from our network: the IP address, the time including time zone, and relevant log lines.
What we do with your report
- Acknowledgement. We confirm receipt of your report, as a rule within one working day.
- Assessment. We assess the report diligently, objectively and promptly. We aim to assess a report within five working days in most cases. Complex reports may take longer. These timeframes reflect our best efforts and are not a guarantee.
- Customer response. As a rule, we inform our customer of the report and give them the opportunity to respond or to remove the content themselves. In urgent or serious cases, we do so only after we have taken action.
- Decision. If the report is well founded, or if the content is manifestly unlawful or criminal, we may remove or disable access to the content, or suspend the service in whole or in part. We choose the least intrusive measure that is sufficient. If we consider the report unfounded, or if the matter is a dispute between parties that only a court can resolve, we take no action.
- Feedback. We inform you of our decision and of the options available to you afterwards.
Decisions on reports from third parties are always made by a member of our staff. In addition, we use automated tools to secure our services, such as a spam filter, a daily malware scan and a firewall. Where a decision was made wholly or partly using automated means, we say so.
We are not a court. Where it is unclear whether content is unlawful, for example in a substantive dispute about an allegedly unlawful statement, we may ask the parties to bring the dispute before a court. We will, of course, comply with any court ruling.
Urgent cases
We act immediately on manifestly criminal content or acute threats, including outside working days as quickly as possible. This includes in any case:
- child sexual abuse material;
- terrorist content;
- an acute threat to the life or safety of persons;
- active phishing, malware distribution or attacks originating from our systems.
Please put the word URGENT in the subject line of your email.
If there is an acute threat to someone's life or safety, always call the emergency number 112 first. Criminal offences can also be reported to the police. Child sexual abuse material can also be reported to Offlimits (formerly the Dutch Child Pornography Hotline), the Dutch centre of expertise on online abuse.
If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of persons has taken place, is taking place or is likely to take place, we inform the competent authorities promptly, as required by Article 18 of the DSA. For other potentially criminal content, we may file a report and provide relevant information to the competent authorities.
Counter-notice from the customer
A customer who disagrees with a report can send a substantiated counter-notice to abuse@wiwomedia.nl, explaining why the content is not unlawful in their view, for example because they have permission from the rights holder or because the statement is protected by freedom of expression.
We take the counter-notice into account in our assessment. If it sheds new light on the matter, we may reconsider or lift a measure and inform the person who made the report. If the reporter and the customer continue to disagree on a matter that is not manifestly clear, we refer them to the courts.
Statement of reasons and objections for customers
If we take a measure against a customer's content or service, we send the customer a clear and specific statement of reasons, as required by Article 17 of the DSA. It sets out what measure we have taken and for how long, the facts on which it is based, whether automated means were used, the legal or contractual ground, and how the customer can challenge it.
The customer can object through our complaints procedure and can always go to court. For the rules that apply between us and our customers, see Article 30 of our terms and conditions and our acceptable use policy.
Privacy of the person reporting
We treat your details confidentially. In principle, we do not share your name and contact details with our customer. The exceptions are:
- where you give your consent;
- where this is necessary to handle a report of an intellectual property infringement, for example because the customer needs to be able to verify that the reporter is the rights holder;
- where we are legally required to do so.
We process the data in your report in order to handle it and to comply with our legal obligations. You can read more about this in our privacy policy.
Disclosure of customer data
We do not simply disclose the name, address or other identifying details of our customers to third parties. We only do so where this is permitted or required by law, for example under an order from a competent authority, or where the conditions set by Dutch case law are met (including that the reporter has a compelling interest, that it is plausible that the content is unlawful, and that there is no less intrusive way to obtain the details).
Misuse of the notice procedure
We assume that reports are made in good faith. If a person or organisation repeatedly submits manifestly unfounded reports, we may, after a warning, decide not to process their reports for a reasonable period. A person who knowingly provides false information may be liable for any damage caused as a result.
